What is the PPWR (Packaging and Packaging Waste Regulation)?<\/h2>\n\t\t\t\t\n\t\t\t\t\t\t\t\t\t<p>The PPWR (Packaging and Packaging Waste Regulation) is a key component of the European <strong>Green Deal.<\/strong> As a uniform, directly applicable framework, it replaces the previous Packaging Directive. The regulation aims to <strong>strengthen the circular economy<\/strong> across the EU, reduce packaging waste, increase recyclability and material efficiency, and <strong>harmonize existing rules throughout the EU<\/strong>.  <\/p>\n\t\t\t\t\n\t\t\t\t\t\t\t<\/div>\n\t\t\t\n\t\t<\/div>\n\t<\/section>\n\n\t\n\n\n\t<section class=\"snk-section snk-section_noBtn\">\n\t\t<div class=\"container\">\t\n\t\t\t\n\t\t\t<div class=\"snk-textBlock\">\n\t\t\t\t\n\t\t\t\t\t\t\t\t\t<h2 class=\"snk-section-headline\">2. Who is affected by the PPWR?<\/h2>\n\t\t\t\t\n\t\t\t\t\t\t\t\t\t<p>The PPWR applies <strong>to all packaging and packaged products placed on the EU market<\/strong>. Starting August 12, 2026, goods packaged in non-compliant packaging may no longer be marketed within the EU.<br \/>Exceptions and specific provisions apply to packaging for dangerous goods, medical devices, sensitive food contact materials, and innovative packaging, providing flexibility where safety or innovation considerations justify it.  <\/p>\n<p>To the question on PPWR roles: The PPWR has an extremely broad scope. What does the PPWR role \u201cProducer\u201d mean, and how does it differ from \u201cManufacturer\u201d?<\/h2>\n\t\t\t\t\n\t\t\t\t\t\t\t\t\t<p>This is a quite often asked PPWR question: Under the PPWR, \u201c<strong>Producer<\/strong>\u201d refers to any producer, importer, or distributor\u2014regardless of where they are established\u2014that places packaging or packaged<strong> products on the market in a Member State for the first time.<\/strong> Producers assume additional obligations, including extended producer responsibility (EPR) for collection and recycling. The term should not be confused with \u201cManufacturer.\u201d   <strong>The Manufacturer is one of the roles covered under the broader term \u201cProducer.\u201d<\/strong> There is also potential for confusion in German terminology: in the regulatory context, \u201cHersteller\u201d refers to the entity responsible for first placing packaging on the market, while \u201cErzeuger\u201d refers to the entity that manufactures packaging or packaged products.<\/p>\n<p>It is important to understand that within a packaging value chain, there is only one Manufacturer, but there may be multiple Producers. Whether a company qualifies as a Producer must be assessed separately for each Member State, depending on who places the packaging or packaged product on the market first.<\/p>\n\t\t\t\t\n\t\t\t\t\t\t\t<\/div>\n\t\t\t\n\t\t<\/div>\n\t<\/section>\n\n\t\n\n\n\t<section class=\"snk-section snk-section_noBtn\">\n\t\t<div class=\"container\">\t\n\t\t\t\n\t\t\t<div class=\"snk-textBlock\">\n\t\t\t\t\n\t\t\t\t\t\t\t\t\t<h2 class=\"snk-section-headline\">6. What does \u201cExtended Producer Responsibility\u201d mean in the context of the PPWR?<\/h2>\n\t\t\t\t\n\t\t\t\t\t\t\t\t\t<p>A key element of the PPWR is the principle of <strong>Extended Producer Responsibility <\/strong>(EPR). EPR compliance requires producers to take responsibility not only for manufacturing and distributing their products, but also for managing the <strong>end-of-life treatment<\/strong> of the associated packaging. <\/p>\n<p>For example, online retailers based in Germany that sell goods to end customers in Austria must appoint an authorized representative in Austria, register in the national producer register, and pay the applicable fees there.<\/p>\n\t\t\t\t\n\t\t\t\t\t\t\t<\/div>\n\t\t\t\n\t\t<\/div>\n\t<\/section>\n\n\t\n\n\n\t<section class=\"snk-section snk-section_noBtn\">\n\t\t<div class=\"container\">\t\n\t\t\t\n\t\t\t<div class=\"snk-textBlock\">\n\t\t\t\t\n\t\t\t\t\t\t\t\t\t<h2 class=\"snk-section-headline\">7. How will EPR fees change under the PPWR?<\/h2>\n\t\t\t\t\n\t\t\t\t\t\t\t\t\t<p>Starting 18 months after publication of the EU criteria, EPR fees will be modulated based on environmental performance. This means the fees will be structured according to how sustainable the packaging is. These obligations cover packaging design and material selection as well as documentation, labeling, traceability, and reporting. <\/p>\n<p>Key obligations\u2014depending on the company\u2019s role\u2014include:<\/p>\n<h3>1. Compliance &amp; chemical safety (from 2026)<\/h3>\n<ul>\n<li>Compliance with limits for substances of concern (e.g., PFAS, heavy metals), especially for food contact materials<\/li>\n<li>Conducting conformity assessment procedures<\/li>\n<li>Preparing technical documentation<\/li>\n<li>Issuing an EU Declaration of Conformity (DoC)<\/li>\n<\/ul>\n<h3>2. Labeling &amp; transparency (from 2028 onward)<\/h3>\n<ul>\n<li>Harmonized labeling on material composition<\/li>\n<li>Information on compostability, take-back schemes, or deposit return systems<\/li>\n<li>Labeling of reusable packaging<\/li>\n<li>Providing information to authorities and market surveillance bodies<\/li>\n<li>Registration and compliance within the framework of extended producer responsibility (EPR)<\/li>\n<\/ul>\n<h3>3. These include, among other things, <strong>verifying compliance<\/strong> of the packaging and ensuring that labeling requirements have been properly fulfilled.<\/p>\n\t\t\t\t\n\t\t\t\t\t\t\t<\/div>\n\t\t\t\n\t\t<\/div>\n\t<\/section>\n\n\t\n\n\n\t<section class=\"snk-section snk-section_noBtn\">\n\t\t<div class=\"container\">\t\n\t\t\t\n\t\t\t<div class=\"snk-textBlock\">\n\t\t\t\t\n\t\t\t\t\t\t\t\t\t<h2 class=\"snk-section-headline\">10. What requirements apply regarding empty space and overpackaging?<\/h2>\n\t\t\t\t\n\t\t\t\t\t\t\t\t\t<p>Starting <strong>January 1, 2030,<\/strong> grouped, transport, and e-commerce packaging may contain no more than<strong> 50% empty space<\/strong>. Filling material is considered empty space. It requires clear allocation of responsibilities within the packaging value chain and leads to greater <strong>coordination efforts between procurement, sustainability, quality management, and suppliers<\/strong>.
