It will apply from December 14, 2027.<\/p>\n<p>Its goal is simple: Any product linked to forced labour must not enter or circulate within the EU market. This includes imports, exports and domestic sales.<\/p>\n<p>Just like the EUDR and CBAM, the regulation takes a product-based approach. It doesn\u2019t matter how big your company is or what sector you\u2019re in \u2013 if a product in your supply chain involves forced labour, the regulation applies.<\/p>\n<p>The new rules build on and complement existing human rights laws like the German Supply Chain Act (LkSG) and the upcoming CSDDD.<\/p>\n\t\t\t\t\n\t\t\t\t\t\t\t<\/div>\n\t\t\t\n\t\t<\/div>\n\t<\/section>\n\n\t\n\n\n\t<section class=\"snk-section snk-section_noBtn\">\n\t\t<div class=\"container\">\t\n\t\t\t\n\t\t\t<div class=\"snk-textBlock\">\n\t\t\t\t\n\t\t\t\t\t\t\t\t\t<h2 class=\"snk-section-headline\">What Counts as \u201cForced Labour\u201d?<\/h2>\n\t\t\t\t\n\t\t\t\t\t\t\t\t\t<p>The regulation uses the definition provided by the International Labour Organization (ILO):<\/p>\n<p><em>\u201call work or service which is exacted from any person under the threat of a penalty and for which the person has not offered himself or herself voluntarily.\u201d<\/em><\/p>\n<p>The ILO lists several warning signs, including:<\/p>\n<ul>\n<li>Exploiting vulnerable people<\/li>\n<li>Deception<\/li>\n<li>Restricting workers\u2019 freedom of movement<\/li>\n<li>Isolation<\/li>\n<li>Physical or sexual abuse<\/li>\n<li>Threats and intimidation<\/li>\n<li>Confiscating ID documents<\/li>\n<li>Withholding wages<\/li>\n<li>Debt bondage<\/li>\n<li>Poor or unsafe working and living conditions<\/li>\n<li>Excessive overtime<\/li>\n<\/ul>\n\t\t\t\t\n\t\t\t\t\t\t\t<\/div>\n\t\t\t\n\t\t<\/div>\n\t<\/section>\n\n\t\n\n\n\t<section class=\"snk-section snk-section_noBtn\">\n\t\t<div class=\"container\">\t\n\t\t\t\n\t\t\t<div class=\"snk-textBlock\">\n\t\t\t\t\n\t\t\t\t\t\t\t\t\t<h2 class=\"snk-section-headline\">What Does This Mean for Supply Chain Managers? <\/h2>\n\t\t\t\t\n\t\t\t\t\t\t\t\t\t<p><strong>In short: You\u2019ll need to expand your due diligence processes and include the ILO\u2019s forced labour indicators in your risk assessments.<\/strong><\/p>\n<p>The Forced Labour Regulation is primarily addressed to national and EU authorities. These authorities are responsible for identifying potential risks and must provide guidance on high-risk regions as well as support services (see also: <a href=\"https:\/\/www.consilium.europa.eu\/en\/policies\/forced-labour-products\/#EUstrategy\" target=\"_blank\" rel=\"noopener\">EU Council \u2013 Explanation of the Investigation Procedure<\/a>). To support this, the EU will set up a dedicated \u201cEU Forced Labour Single Portal.\u201d<\/p>\n<p>If authorities identify signs of forced labour in a company\u2019s supply chain, further investigations will follow.<\/p>\n<p>To comply with the new regulation and demonstrate that your supply chains are free from forced labour, your company will need:<\/p>\n<ul>\n<li><strong>Supply chain transparency<\/strong> \u2013 Gain a clear overview of potentially high-risk products, suppliers and manufacturers.<\/li>\n<li><strong>Active supplier management<\/strong> \u2013 Collaborate with your suppliers to eliminate forced labour risks in your supply chains.<\/li>\n<li><strong>Enhanced due diligence processes<\/strong> \u2013 Build on the structures you already have in place for existing regulations. So why introduce a separate Forced Labour Regulation?<\/p>\n<p><strong>The key difference lies in scope and focus.<\/strong><\/p>\n<ul>\n<li>Unlike the CSDDD, the Forced Labour Regulation applies across all sectors and is not limited to companies with a certain turnover or number of employees.
